Spa. Este trabajo académico tiene como objetivo la creación de una herramienta bibliográfica denominada “Diseño de un manual de prevención y reacción jurídica ante accidentes laborales en empresas de construcción en Colombia”, que permita al gremio de la Construcción optimizar el tratamiento jurídico frente a la existencia de un accidente de trabajo en trabajadores de la construcción, con el fin de reducir riesgos tanto jurídicos como patrimoniales frente a la existencia de una contingencia o accidente laboral. El resultado, se consigue llevando a cabo el cumplimiento de tres etapas importantes; La primera es el desarrollo de los objetivos específicos uno y dos quedarán un diagnóstico de la implementación de la normatividad de riesgos laborales, seguridad y salud en el trabajo para los trabajadores de la construcción. Preámbulo de la situación jurídica actual en materia por parte del gremio, que representa los objetivos específicos número uno y dos que identificará las falencias en materia de riesgos laborales, seguridad y salud en el trabajo por parte de los involucrados en la cadena con motivo de la ocurrencia de un accidente laboral para identificar los parámetros de prevención y reacción que hubieran evitado llegar a esas estancias, teniendo clara una identificación integral del tratamiento jurídico por corregir. Finalmente, el último objetivo se cumple con la elaboración del manual, donde se propone la mejora al procedimiento establecido por el Gremio Constructor para optimizar la calidad en el tratamiento jurídico de prevención y reacción frente a la existencia de un accidente de trabajo en trabajadores de la construcción.

Eng. The objective of this academic document is create a bibliographic tool called "Design of a manual for the prevention and legal reaction to workplace accidents in construction companies in Colombia", which allows the Construction union to optimize the legal treatment of the existence of a work accident in construction workers, in order to reduce both legal and patrimonial risks in the face of the existence of a contingency or work accident. The result is achieved by carrying out the fulfillment of three important stages; The first is the development of specific objectives one and two will remain a diagnosis of the implementation of the regulations on occupational hazards, safety and health at work for construction workers. Preamble of the current legal situation on the part of the union, which represents the specific objectives number one and two that will identify the shortcomings in terms of occupational risks, safety and health at work on the part of those involved in the chain due to the occurrence of an occupational accident to identify the prevention and reaction parameters that would have prevented reaching those rooms, having a clear comprehensive identification of the legal treatment to be corrected. Finally, the last objective is fulfilled with the elaboration of the manual, where the improvement of the procedure established by the Construction Guild is proposed to optimize the quality in the legal treatment of prevention and reaction against the existence of an accident at work in workers of the construction.
